The following describes the terms and conditions that are entered into between The Service Provider (the "activity provider" and/or "its facilities") hereinafter called Partner and "ColombiaTours.Travel" ("ColombiaTours.Travel", "we" and/or "us" and/or "our").

"ColombiaTours.Travel" provides an online platform called "ColombiaTours.Travel", which facilitates the connection of providers of tourist activities such as: tours in nature reserves, city tours, bicycle tours, accommodation, spas, events, tickets and other tourist activities with users who are interested in participating in such activities, whose services are accessible at https://colombiatours.travel and any other website through which ColombiaTours.Travel makes its services available.

Article 1

With this agreement you grant us the right to publish your activity, experience or tourist service within our platform, for this you agree and accept the following terms and conditions.

Article 2

The Contract is formalized once you communicate us through our platform all the descriptive and booking information about your activity, experience or tourist service, the Colombiatours.travel support team will notify you when the information is approved and validated and available for user booking.

To post an activity on the form you must enter the following in the Activity Registration Form:

• Full name, short description and long description of the experience, activity or tour.
• The type of activity you will provide.
• Rates, days and the exact times you will provide the user with the activity or tour.
• What is included and what is not included.
• Itinerary of the experience, activity or tour.
• Featured image of the experience or activity.
• Images, photographs and/or videos of the activity or service.
• Additional information regarding the activity.

You agree that we may unexpectedly suspend our intermediation obligations described in this contract without any compensation in case of technological problems such as accidents in telecommunications companies, natural disasters, maintenance and server / service updates and other technological problems on the site ColombiaTours.Travel.

Article 3

We will decide the price of the activity by mutual agreement between you and us, as well as the commission you will pay us.

You agree to give us the lowest price you have listed for the same activities on your own website or on services similar to ColombiaTours.Travel.

Article 4

You will register information to be published on our platform, including service or product features, images for your profile and detailed activity ("Profile Information and other similar information") using the forms we specify.

You warrant that the profile information and other similar information you provide to us does not violate or infringe the copyrights or other intellectual property rights of any third party.

Profile information, services and other similar information that you have provided to us and posted on our site is subject to change by us at any time.

Article 5

You will provide the activity or services to the user, according to the activity booking confirmation notification sent to the registered email address.

You will be responsible for the cost of performing your activity.

You will notify us immediately if you are unable to provide an activity to a user or if you are unavailable to provide users with your activity.

You will promptly notify us of any user complaint about the activity you provide.

If you plan to have any type of money transaction to accompany the activity you provide, such as selling tickets or merchandise, you will notify us in advance.

Article 6

You will not take any action, such as promoting your company in the activity description or any material related to the activity, to circumvent this intermediary agreement. Example: receiving payment for the activity directly from the user to yourself without us being the intermediary.

If you are found to be breaking the above points, you will compensate us double the amount you received from a user for the loss.

Article 7 (Obligation of Confidentiality)

You will not use any private information about the user or the user's family that is written on the Activity booking confirmation notice or any information you have acquired in the course of conducting your activity, except for the purpose of providing your activity.

You shall not disclose the user's private information to third parties unless you are subcontracting your activity and provided that this information relates to that specific third party to which you are subcontracting.

By providing an activity to us, you will handle the user's private information in accordance with our privacy policy and applicable laws and regulations.

Article 8 (Damages)

You agree and understand that we are not liable for any damages of any kind that are inflicted on a user through your activity and that you are fully responsible for any damages - provided that the problem does not result from our server with a third party server, provider, or our network or server.

If we receive complaints or damages from users and/or third parties directly related to your activity, you are fully responsible for the fee to resolve the complaint or claim for damages.

If you do not provide the activity you have written on our platform, you are responsible for the fee we have to pay.

Article 9 (Article relating to the receipt of its activity fee on behalf of the service provider)

You will pay the value of the activity in accordance with the method we designate on your behalf.

Payment will be made to us when the user registers an activity and will be transferred to you via bank consignment after the activity starts, provided that the user has no complaints with the quality of service of your activity.

If the experience is provided in Colombia, payment will be transferred to your bank on the last day of the month following the month in which the activity was performed to a separately specified bank account.

The specified payment minus the commission (hereinafter referred to as "payment"), will be paid to you or your intermediary.

Payment shall be made in Colombian Pesos. In the event that the specified price is in a currency other than the Colombian Peso, payment will be in Colombian Pesos. We will determine the exchange rate, taking the official exchange rate of the day in which the reservation is made.

You are responsible for payment transaction fees.

Article 10 (Duration of the contract)

After you accept this contract, this contract is valid for 1 year.

If there is no written request by you or us three months before the expiration of the contract, the contract will be automatically extended for one year under the same conditions and will be made thereafter.

Article 11 (Termination)

You or we may dispense with this contract immediately and make claims for damages against each other without notice, if we or you request the following:

(I) Breach this Agreement and fail to address the issue within 30 days of notice being sent via written notice.

(II) Is under a claim of an eviction order, provisional attachment order, provisional disposition and auction or in the process of recovery of back taxes or any other legal penalty process, as well as being in the process of bankruptcy, corporate reorganization, civil rehabilitation and/or special liquidation proceedings.

(III) When there is inappropriate and/or improper behavior by a user.

(IV) When it damages the credibility of ColombiaTours.Travel or interferes with the operation of the platform and any other service we provide.

(V) If we are in the middle of a criminal process or proceeding.

Article 12 (Applicable Law and Competent Jurisdiction)

If there is a dispute about the rights caused by this contract between you and us, the Colombian justice will legislate according to the Commercial Laws stipulated in Colombia.
